Angela Rayner

a tax adviser says:

Tax adviser Mr McCann said: "I don't think there's any credible case to be made that she's deliberately evaded tax. I don't see that as likely.

"Worst case scenario is that she didn't realise it. She wasn't Angela Rayner, deputy leader of the Labour Party, she was a care worker. These rules are very complicated."

He points out that mistakes can be remedied with HMRC within four years so it's now out of time - although she could choose to pay money back if found to owe anything.

oh dear, gasbag says its not out of time, tax advisor says it is

Its not true.

She sold her house in March 2015
She became an MP in May 2015.
Her Liability to pay capital gains on the property was while she was an MP.

and to correct the above:
HMRC investigation time limit is 4 years if an innocent error is suspected; where mistakes in tax returns are deemed careless or negligent, the window extends to 6 years. Suspicion of deliberate tax evasion warrants an investigation period of 20 years. and of course there is no statute of limitation on criminal prosecutions.

Notchy 0 gassy 1.

Its out of time for her to pay the tax, not for HMRC to come after her.

I'm saying she was an MP when she had the obligation to pay the tax.

My view of if it was deliberate or not is irrelevant, her story doesn't stack up. I personally think it was an oversight/misunderstanding.

Few people consider the financial/tax consequences of getting married - me included :|

You are not actually saying anything. Certainly not to dispute what the specialist tax adviser said.

Are you now a tax advisor specialist too? Another string to add to your world class CV. Really don't understand why you are on a diy forum with all that under your belt.

I don't know much about capital gains tax. So can you just clarify the process for me.

The tax liability is for the 2014-2015 tax year? And does that then go on the tax return, which has to be done by January 2016. What questions are on that form which might be relevant to her. Does it, for instance, ask whether you have sold a property and, if so, was it your main residence.

You are contradicting yourself

You said
oversight/misunderstanding
And you said

time limit is 4 years if an innocent error is suspected

An oversight / misunderstanding is an innocent error

It is not:

careless or negligent

I'm not disagreeing with the advisor. He has been misquoted. He has not said the time limit for HMRC to come after her has expired. It hasn't. The time limit for her to declare the unpaid tax has expired.

The issue, is not how much she owes, not if she did it deliberately, but the hypocrisy of denying wrong doing, while at the same time being a fog horn for other's tax misdemeanours.

This article sums it up well..

Standard CGT yes, but CGT derived from the disposal of property is due within 60 days. I suspect she wasn't subject to self assessment at the time, not that its relevant.
