chimney ownership help

All,
I hoping you can help on a 'dispute'. My neighbour has informed he is claiming damages for water damage caused by deterioration of a disused chimney.

Why he never told us there was an issue I don't know. That's for another day.

The chimney is at the back of the house, and am told were common, for a small copper fire in the kitchen (when toilets were outside). We didn't know it was ours but pokes mostly through the neighbours roof. Is it solely my responsibility, his as his roof or shared?

To be clear I want to get it sorted but not sure I should or need to pay for his bedroom.
 
Do you have photo? Are there two flues in the chimney one for each house? does he have evidence that the water is coming from your flue or is he claiming it's from the flashing.
 
Hi chappers sorry for the delay. Here you go. Place on right is ours. On the left theirs. Water he said is coming direct underneath the chimney stack.

It is likely to be his own flashing which is the problem. I can't see how the flue can be the cause.
 
Its looks a bit unusual.
I would agree, are you saying the chimney used to serve your property, but that it is sat over his property. the flashing does look a bit suspect.
What about the other chimney at the top of the picture ? the slating would indicate that both are on your side, whereas if the addition is his then, that would indeed be a strange set-up.
