Garden Room Height close to boundary

Hi, very much hoping i can get some advice on this

My garden room is right next to the boundary, around 100mm or less
The height on one side is 2.64m, however at the rear where ground level is higher its 2.46m, is this within regulation ?
However the building is made of substantially non-combustible materials, does this change this?

You're mixing up planning and building regs. To be permitted development (which only refers to planning):-

For planning, if it's less than 2m from a boundary it has to be <2.5m measured at the highest point of the ground adjacent. @2.46m you are AOK.

For Building Control/regs, if it is <1m from boundary AND >15sqm internal floor area, it has to be substantially non combustible materials - yours is so you are AOK. If it is >30sqm internal it needs B Regs whatever.

Unless you are in a conservation area, listed building or have had PD rights withdrawn, it looks like you are PD.

Assuming it's <30sqm internal floor area, You don't need to make any applications or seek any approvals.

Thank you! the internal floor area is under 15m2
