Neighbours boundary dispute

Thank you for your reply. I am so tempted to write to him, but, have
refrained so far. I am also much happier this morning, now that I have
gone through my Title Deeds, page by page & read & studied the OS
maps, from when I bought the property in 2008. And the boundary/party
wall goes straight through the centre of both properties toi the road.
My solicitor at the time wanted to retain the deeds, but, I, (very thankfully
now) insisted of having them. Will upload them just now.
My old neighbour's family have also been in touch & have said the front
guttering was one 10mt length, until the new neighbours moved in & had
it cut when they replaced the gutters.

Good afternoon,

I have not been on here for some time. I have lived here in my semi-detached bungalow
since 2008.

In 2009 my son created for me, a flower bed with railway sleepers, under my front windows, in my garden.
He measured with a plum line as accurately as possible to get in the correct position.

I had an elderly neighbour next door, who I was very good friends with & looked out for
her if she had any problems, Sadly she died December 2017 & the present neighbours
moved in Summer 2018. Whilst I was away in 2018, they changed their guttering,which
was shared with my property & I noticed in the winter of 2018/2019 that
my front guttering was leaking quite badly & found out the join between the
2 properties had been pulled away each other. In 2020 I had to stop them
hammering nails into my rear wooden fence.

Yesterday, I was mowing my front lawn, when the male neighbour confronted me
& stated my garden sleeper was on his property & could I move it. It's been in position
for 12 years. In was quite surprised & I have spoken to my son, who has suggested,
should he approach me again, that he needs to provide written proof from a Chartered surveyor
& through his solicitor only. We are talking of about 25mm or less

Any comments, suggestions or advice please.

Good afternoon & a very blustery cold day it is too.

I have now gone through my title deeds & found the OS Map
of my property, when I bought it in 2008. And I am very happy
to say that the boundary/party line, goes straight through both
properties, down to the road.

I have gone through these T D so many times & only found
what I was looking for this morning. I also have legal cover,
should he now want to contest my evidence.

Will keep you updated with the outcome.

Thanks to everyone who has replied & offered help & advice.

Well done, there is little doubt where the true boundary is on that map. The 'T's indicate who owns and is responsible for the fences. Looking at the photos and the map - it looks as if your neighbour has used part of you property, to install his drive. Your fence put in the proper location, would cut across the end of his drive.

It's worth asking, has there just been the one conversation? If so then your initial 'no, go away' might be enough. The normal line is that boundary disputes cost a fortune and are horrible in all ways to everyone involved except lawyers.

Thank you for your reply. There has only been the one conversation.
He may not take too kindly to learning the truth. It does not appear
that he has checked his title deeds. A very arrogant & cocky man,
feeling great bullying a woman. But, his days are numbered.

Just be wary that whatever the legal rights and wrongs, someone like him can make your life a living hell, and the police will do SFA.
Correct!
In fact, the police would come against you.
They always go for the weaker pray so to protect criminals and tick their boxes.
I lost faith in the police when they became a social service instead of criminal chasers.
 
If you were feeling more bold, you could buy a can of that builder/surveyors marker spray - then whilst he was out.....

Put a string line going at a carefully measured right angle from you bungalow's party wall, to the road side, then mark along the line with your spray.

I cannot with the above comment from Johnny - the police always go for the bully in my limited experience.

Thank you for your reply. Yes!! I have just looked at that marker spray paint on ebay
& will buy it. Various colours. Yellow/orange would stand out the most. I have taken
a photo of the diagram by Bernard Green, which is really very helpful. I would like to
think of the police in friendlier terms & I certainly would hate to waste their precious
time with this sort of thing. Especially when I did not start the dispute, but, I will end
it shortly. I sent an email to admin last week & still no reply. I have 2 profiles on
here, and my other one goes back to 2008 & was hoping to get that sorted out.

& marking the boundary, with a very bright colour, so that it cannot be missed.

If it achieves nothing else, it will put him in his place and make it clear you are not to be messed with. I assume you or your predecessor in the bungalow gave his predecessor unofficial leave to encroach on your land with the building of the drive. As he will have nothing official as regards permission, that leave can be rescinded and he stands to have some of his drive access restricted.

I'm in a similar delicate position to your neighbour - both of my next door neighbours 'donated' a strip 1' x 75' when they decided to install new fences, so I try to keep things sweet between us :-)

The previous owner of next door's property, moved in in the 80's when it was
a new build. She was a widow on her own & did not drive.
I am the third owner of my house & I believe the first owners were here for about
14 years. I put the fence up a few years ago, on my property & at my own expense,
as pedestrians would walk past our windows daily, looking in & this caused the old
lady to say she was very concerned.
As how his driveway arrived in it's present position, I don't know.
