The post is about the tagging of illegal immigrants. The beeb article says it's been ruled illegal, it hasn't.
You're swerving.

You said,
"The Enforcement Notice issued by the ICO orders the Home Office to update its internal policies, access guidance and privacy information in relation to the data retained from the pilot scheme."

Nothing ruled illegal, just an enforcement notice to update the policy and procedures.

They absolutely ruled it was illegal, a breach of UK law.

The BBC article says the asylum seeker claimed that it was unlawful, but that, "The Home Office said that "outside of the pilot" electronic monitoring was still used."

There's a big difference.

they have not ruled tagging illegal immigrants is illegal

From the ICO

The Enforcement Notice issued by the ICO orders the Home Office to update its internal policies, access guidance and privacy information in relation to the data retained from the pilot scheme.

and you can read the enforcement notice here if you like..

The headline
An asylum seeker wants to know why he has to wear an ankle tag, given the practice has been deemed unlawful.

The practice of tagging illegal immigrants has not been ruled unlawful.

The Answer is - because it hasn't
Home Secretary has the power and the ICO cannot remove that statutory power.

of course the processing of the data is under the ICO remit, and they have ordered changes. see above.

Agreed, not in dispute.

I've already read it.

Yes, and said that what they did breached UK law. You claimed,
Nothing ruled illegal, just an enforcement notice to update the policy and procedures.
That's wrong.

So now we are clear.
tagging not ruled illegal and the ICO has issues with data processing not tagging.

Hence

They absolutely ruled it was illegal, a breach of UK law.
is incorrect. Because it hasn't and the ICO didn't and couldn't

The enforcement notice was entirely limited to the handling of data and inadequate policy and procedures.

hence

Nothing ruled illegal, just an enforcement notice to update the policy and procedures.[/

The enforcement notice was entirely limited to the handling of data and inadequate policy and procedures.
And the way they dealt with it was a breach of UK law.

It's you who keeps bringing up tagging, not me.
