It's so long ago since I sold a house that I can't remember the process. But it seems that if you sell your main home you don't need to complete any sort of form.



If AR believed she was entitled to PRR, would there have been anything at all that she signed or declared to that effect?
none of that is relevant to selling your home.

She also denies renting the property out, you cannot claim tax relief on tax you have not paid,...well you could try.

she has not made a false declaration as far as we know... its failure to notify.

HMRC are more forgiving on people who tell them they owe some tax, but get the amount wrong.
They are less impressed with people who fail to tell them they owe some tax, because they didn't understand the rules.

Can you please just explain simply the rules for somebody who sells their main home and is entitled to PRR. You know this stuff and I don't. What forms and declarations do you have to make as regards CGT if it is your main home and is fully covered by PRR?

So, just to be clear, as far as we know, this is not a case of somebody going out of her way to deceive HMRC e.g. she's never actually signed something claiming the property was her main residence.
 
When she sold her house her failure to notify was exactly that.

here is how you work it out..

PRR is not relevant to selling your home. It's relevant to selling a house that is not your home anymore

When you sell a property that is not your main home you get various allowances:
