Not much point in reporting something that occurred before the law came into force.
You've not really got your head around this concept of aggravated by prejudice. There is no time limit on the "single source". Historic sources would do just fine.
 
We do not have similar laws in England and Wales.

In England and Wales a person is free to be prejudiced against Jews and transgender for example without these being counted as aggravating factors should they be accused of a public order offence.

There is a big difference between having hate as a motive and simply being prejudiced.
But it's not a long stretch between acting upon the prejudice with hate, given the circumstances: such as the rise in anti-semitic and anti-muslim sentiment as the war in Gaza has progressed.
 
I think people may be misunderstanding the mitigation/aggravating concepts in criminal law.

A - commits a crime against another - the sentence is X

A - has mitigating circumstances - e.g. provocation. the sentence is X - Y
A - has aggravating circumstances - e.g. hate motivation. the sentence is X + Y

The new Scotland legislation removes mitigation and allows prejudice (even historic) to be an aggravating factor.
 
Historic prejudice will seriously compromise the simple joy of slanging songs back n' forth at the next England-Scotland international. :LOL:
